Sterlingoods LLC ("Sterlingoods," "Capsucup," "we," "us," or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and safeguard information when you visit our website at www.capsucup.com (the "Site"), purchase our products through our online storefronts or marketplaces, or otherwise interact with our business (collectively, the "Services").

1. About Sterlingoods LLC
Sterlingoods LLC is a Florida limited liability company (EIN 82-5485035) operating as a U.S. importer and distributor of premium Italian coffee products and specialty foods. We sell direct to consumers through our own website (www.capsucup.com) and through online marketplaces including Amazon.com, Walmart Marketplace, and eBay, and we also serve B2B wholesale accounts. Our products include single-serve coffee capsules compatible with Nespresso Original and Dolce Gusto systems, sold under our brands ESPRESSORO, FORTISSIMO, GIMOKA, and others, as well as Sicilian pistachio cream and related specialty foods.
This Privacy Policy applies to personal information we collect through our Site and Services. Information you provide on third-party marketplaces (Amazon, Walmart, eBay) is governed by both this policy and the privacy policy of the relevant marketplace.
2. Information We Collect
2.1 Information you provide to us
We collect personal information you submit directly when you:
- Create a customer account
- Place an order
- Subscribe to our newsletter or SMS list
- Contact our customer support
- Participate in a survey, promotion, or contest
- Apply for a wholesale (B2B) account
This information may include: first and last name; shipping and billing address; email address; phone number; payment information (processed directly by our payment processors — we do not store full card numbers); order history; account credentials; communications you send us; and, for wholesale customers, business name, EIN, and resale certificates.
2.2 Information collected automatically
When you use our Site, we automatically collect:
- Device and usage data: IP address, browser type and version, operating system, device identifiers, referring URL, pages viewed, time on site, click-stream data, and language preferences.
- Cookies and similar technologies: see Section 6 below.
- Approximate location: derived from your IP address (city/region level, not precise GPS).
2.3 Information from third parties
We may receive information from:
- Marketplaces (Amazon, Walmart, eBay): when you purchase our products through these platforms, the marketplace provides us with order details and limited customer contact information necessary to fulfill your order.
- Social media platforms (Facebook, Instagram, TikTok, Google): if you log in or interact with us through a social platform, we may receive your name, public profile, and contact details consistent with your platform settings.
- Advertising and analytics partners: Google, Meta, and TikTok may share aggregated audience and conversion data with us.
2.4 Information we do not collect
We do not knowingly collect Social Security numbers, government-issued ID numbers, biometric data, precise geolocation data, or sensitive personal information as defined under the CPRA. We do not knowingly collect personal information from children under 13 (see Section 11).
3. How We Use Your Information
We use personal information for the following purposes:
- To fulfill your orders: process payments, ship products, send order confirmations and tracking, handle returns and refunds.
- To manage your account: create and maintain your customer account, authenticate you, and provide account-related features.
- To communicate with you: respond to support inquiries, send transactional emails, and provide service-related notices.
- To send marketing communications (only with your consent): newsletters, promotional offers, abandoned-cart reminders, and product recommendations. You can unsubscribe at any time using the link in any marketing email, by replying STOP to any SMS, or by emailing us.
- To improve our Services: analyze usage patterns, test new features, troubleshoot, and enhance user experience.
- For advertising: serve relevant ads on third-party platforms (Google, Meta/Facebook/Instagram, TikTok) and measure ad performance.
- For security and fraud prevention: detect and prevent fraudulent transactions, abuse, and security incidents.
- To comply with legal obligations: tax records, accounting, regulatory requirements (FDA food product traceability, customs records), and lawful requests by public authorities.
We do not use your personal information to train artificial intelligence or machine learning models.

We share personal information only as described below. We do not sell your personal information for monetary consideration.

All service providers are contractually required to protect personal information and use it only for the services they provide to us.
4.2 Other disclosures
- Legal compliance: we may disclose personal information when required by law, valid subpoena, court order, or government request, or to protect our legal rights, property, or safety, or the safety of others.
- Business transfers: if Sterlingoods LLC is involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction. We will notify you and any successor will be bound by the terms of this Privacy Policy or provide notice of changes.
- With your consent: for any other disclosure not described above.
4.3 What we do not do
- We do not sell your personal information for money.
- We do not rent your contact list to third parties.
- We do not share personal information with data brokers.
- We do not use your data for AI/ML training.
5. "Sale" and "Sharing" Under California Law (CPRA)
While we do not sell personal information for money, we acknowledge that the use of advertising cookies and pixels (Google, Meta, TikTok) may be considered "sharing" personal information for cross-context behavioral advertising under the California Privacy Rights Act (CPRA). California residents have the right to opt out of this sharing.

6. Cookies, Pixels, and Tracking Technologies
We and our service providers use cookies, pixels, web beacons, and similar tracking technologies to operate the Site, remember your preferences, analyze usage, and serve relevant advertising.

- Strictly necessary cookies: required for the Site to function (e.g., shopping cart, secure checkout, login). Cannot be disabled.

By providing your mobile number and opting in to our SMS program, you consent to receive recurring automated marketing text messages from Sterlingoods (Capsucup) at the number provided. We do not share mobile opt-in data or SMS consent with third parties for marketing purposes. Phone numbers collected via SMS opt-in are used only for the SMS program and order-related communications.
8. Your Privacy Rights
8.1 California residents (CCPA / CPRA)
If you are a California resident, you have the following rights:
- Right to know: request information about the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it.
- Right to delete: request deletion of personal information we have collected from you, subject to legal exceptions.
- Right to correct: request correction of inaccurate personal information.
- Right to opt out of sale or sharing: opt out of the sale or sharing of personal information (see Section 5).
- Right to limit use of sensitive personal information: we do not use sensitive personal information for purposes that would trigger this right.
- Right to non-discrimination: we will not deny you services, charge you different prices, or provide a different level or quality of service because you exercised your rights.
- Right to data portability: receive your personal information in a portable format.
Categories of personal information collected in the past 12 months: identifiers (name, email, phone, address, IP), commercial information (purchase history), internet/network activity (browsing, cookies), geolocation (approximate, IP-derived), inferences drawn from the above for marketing personalization. Categories of sources and recipients are described in Sections 2 and 4 above.

We may need to verify your identity before fulfilling your request. You may also authorize an agent to make requests on your behalf with appropriate proof of authorization.
8.2 Other U.S. state residents
If you reside in Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Tennessee, New Jersey, New Hampshire, Minnesota, Maryland, Indiana, Kentucky, Nebraska, or Rhode Island (as applicable to your state's law), you may have similar rights to access, delete, correct, and opt out of targeted advertising and the sale of your personal data, as well as the right to appeal a refusal of a request. 8.3 California "Shine the Light" (Civil Code §1798.83)
California residents may request a list of third parties to which we have disclosed personal information for those third parties' direct marketing purposes during the prior calendar year. We do not currently share personal information with third parties for their independent direct marketing purposes.
9. Data Retention
We retain personal information only as long as needed for the purposes described in this Policy:

After the applicable retention period, we delete, anonymize, or aggregate personal information unless a longer period is required by law.
10. Data Security
We implement and maintain reasonable administrative, technical, and physical safeguards to protect personal information, including:
- Encryption in transit: all data transmitted to and from our Site is encrypted using TLS 1.2 or higher (HTTPS).
- PCI-DSS compliant payments: all payment card data is handled by PCI-DSS Level 1 certified processors (Shopify Payments / Stripe, PayPal, Amazon Pay). We do not store full payment card numbers on our systems.
- Access controls: personal information is accessible only to authorized Sterlingoods personnel with role-based permissions. All operational accounts (Shopify, Amazon Seller Central, Walmart Seller Center, Klaviyo, Veeqo, email) are protected by strong passwords and two-factor authentication (2FA).
- Vendor due diligence: we evaluate the security practices of service providers before sharing personal information.
No method of transmission over the Internet or electronic storage is 100% secure. While we use commercially reasonable measures to protect your data, we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you and applicable authorities consistent with the requirements of Florida Statutes § 501.171 and any other applicable law (generally within 30 days of discovery).
11. Children's Privacy (COPPA)
Our Services are intended for adults aged 18 and older. We do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If you are a parent or guardian and believe your child has provided us with personal information, please contact us at hello@sterlingoods.com and we will promptly delete the information, subject to legal retention requirements.
For California residents under 18, California Business and Professions Code § 22581 allows you to request removal of content you have publicly posted on our Site. Contact hello@sterlingoods.com with the email address associated with your account.
12. Third-Party Links and Marketplaces
Our Site may contain links to third-party websites, social media platforms, and online marketplaces (Amazon, Walmart, eBay). When you click such a link or purchase our products on a marketplace, the third party's privacy policy — not this Policy — governs the information collected on that platform. We encourage you to review their privacy practices.
13. International Visitors
The Services are operated from the United States and intended for U.S. residents. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States. We do not actively market or ship to the European Union or United Kingdom; if you nevertheless provide personal information to us from those regions, you consent to this transfer.
14. "Do Not Track" and Global Privacy Control
We honor the Global Privacy Control (GPC) signal as an opt-out of sharing personal information for cross-context behavioral advertising. Our Site does not currently respond to legacy "Do Not Track" (DNT) browser signals, as there is no industry standard for interpreting DNT.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised Policy on this page and update the "Last updated" date above. For material changes, we will provide additional notice (such as an email to registered customers or a banner on our Site) before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
